2. Subject of the service
2.1. Hackera Rewards is a technology platform intended mainly for businesses, companies, agencies, startups and other eligible business customers.
2.2. The platform provides an interface for managing virtual cards and related features, to the extent they are activated for the relevant customer and supported by the applicable payment or card partner.
2.3. Depending on the specific plan, availability and approval by the relevant partner, the service may include creating and managing virtual cards, setting spending limits, viewing transactions and technical tools for managing business spend.
2.4. Hackera is not a bank and should not be considered a payment card issuer, a payment institution or an electronic money institution, unless this is expressly established by applicable law and the relevant regulatory status.
2.5. Cards are issued or provided through the relevant approved card services provider. The specific issuer, the applicable terms and the limitations are shown to the customer before the service is activated.
2.6. Accepting payments through Stripe does not automatically mean the customer is entitled to use a virtual card issuing service. Activation of such features depends on the relevant product, approval and contractual terms.
3. Registration and eligibility
3.1. The service is intended for lawful business purposes. Access may be limited to legal entities, sole traders and other categories of customers that are eligible under the rules of the relevant partner.
3.2. When registering, the customer provides accurate, current and complete information about itself and its representatives.
3.3. The customer agrees to provide additional documents for identification, ownership, representation or verification of its activity, where these are requested by the Provider or the card partner on a lawful basis.
3.4. Registration does not guarantee approval to issue or use a card.
3.5. The Provider or the relevant partner may refuse, restrict, suspend or terminate access to a particular feature because of an applicable legal requirement, a failed check, suspected fraud, a breach of these terms or a material security risk.
4. Virtual cards
4.1. A virtual card is an electronic card instrument whose creation and use depend on the technical capabilities and terms of the relevant card partner.
4.2. The customer may create virtual cards only if this feature is activated and the customer has been approved.
4.3. The ability to create multiple cards, set limits and restrict use by merchant type or other category depends on the features actually available.
4.4. A virtual card is not in itself a bank deposit, a payment account or a guarantee that funds are available.
4.5. The customer is responsible for giving access to cards only to authorised persons and for using them for lawful business purposes.
5. Payments, fees and subscriptions
5.1. The price of the service, applicable fees, the billing period and the included features are shown on the website or in an individual offer before the order.
5.2. If a subscription is offered, the customer agrees to its price, frequency and renewal terms before it is activated.
5.3. Payments for the service may be processed through Stripe or another disclosed payment provider. Their processing is also subject to the applicable terms of that provider.
5.4. Card partner fees, currency conversion, transaction fees and other additional costs apply only where they are stated in advance or form part of the terms of the relevant provider.
5.5. The Provider issues accounting documents for its own services in accordance with applicable legislation. Third parties may issue documents for the services they provide independently.
6. Using the platform
The customer agrees:
- to use the platform only for lawful purposes;
- not to commit fraud, money laundering or other illegal operations;
- not to use the service for activities prohibited by the applicable rules of card schemes or partners;
- to keep access credentials confidential and to report unauthorised access promptly;
- not to bypass technical restrictions or security measures;
- to provide truthful information at registration and in later checks.
7. Availability and changes
7.1. The Provider makes reasonable efforts to maintain the platform, but does not guarantee uninterrupted operation.
7.2. Planned maintenance, technical problems, interruptions of external services and changes required by providers or regulators are possible.
7.3. Features described as future, experimental or under development are not treated as available services and are not part of what has been agreed, unless otherwise agreed in writing.
8. Intellectual property
The software, design, texts, trade marks and other materials of Hackera are protected under applicable law. The customer receives a limited, nonexclusive and nontransferable right to use the platform for the term of the agreed service.
9. Suspension and termination
9.1. The customer may cancel its subscription in the way shown in the account or in the individual offer.
9.2. The Provider may restrict or terminate access in case of a material breach, a legal obligation, a security risk or termination of the service by the card partner.
9.3. Terminating access to the platform does not automatically cancel obligations for transactions already made, fees due or applicable dispute resolution procedures.
9.4. Terminating or blocking a card is carried out under the terms of the relevant issuer and the applicable rules.
10. Liability
10.1. The Provider is liable for its own obligations under applicable law.
10.2. The Provider does not guarantee approval of a customer, successful authorisation of every transaction, uninterrupted availability of third party services or any specific value of rewards.
10.3. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.
10.4. Responsibility for card operations, customer funds, declined transactions, refunds and disputes is determined by the applicable agreements with the issuer, the payment provider and the card schemes, as well as by mandatory legal rules.
11. Personal data
Personal data is processed under the Hackera Rewards Privacy policy and applicable data protection legislation. For certain operations, the card or payment partner may process data as an independent controller.
12. Complaints and contact
Questions, reports and complaints can be sent to: support@hackera.online.
For a problem with a specific transaction, the customer should also use the applicable procedure of the relevant card issuer or payment provider.
13. Governing law
These terms are governed by the applicable law of the Republic of Bulgaria and European Union law, to the extent applicable. Nothing in this section limits mandatory rights or jurisdiction rules that the law gives to the relevant customer.
14. Final provisions
If any provision is found to be invalid, the remaining provisions stay in force, to the extent permitted.
The current version of these terms is published on the Hackera Rewards website. Material changes are communicated in an appropriate way, where required by law or contract.
